In that letter, you state that Bracken CableVision is not required to justify its rates prior to May 15, 1994 because Bracken CableVision's Augusta, Kentucky system had 594 subscribers as of the date of the complaint. You further state that as of June 23, 1995, the number of total subscribers is 570. Based on the information you have provided, it appears that the Bracken system qualifies as a "small system" pursuant to 47 C.F.R.  76.901(c), as amended, and was therefore exempt from rate regulation until May 15, 1994. We will rule at a later date on Bracken CableVision's justification under the Commission's revised rate regulations of its cable programming service rate in Augusta beginning May 15, 1994.
