By the Chief, Cable Services Bureau:

     On May 5, 1995, the Cable Services Bureau released an Order (DA 95-1003) granting
complaints that had been filed with the Commission challenging the reasonableness of the
cable programming service ("CPS") price charged by Time Warner Cable of New York
("Operator") in Southern Manhattan, New York.  The Order did not address the fact that
Operator filed an amended Form 393 filing on February 7, 1995 in response to a Cable
Services Bureau Public Notice offering operators the opportunity to make optional
supplemental filings.  In accordance with the Public Notice and pursuant to Section 76.960
of the Commission's Rules, 47 C.F.R.  76.960, we find that Operator shall not be required
to obtain advance Commission approval of adjustments to its CPS price in Southern
Manhattan, New York for one year following the release of the May 5, 1995 benchmark
order.



     This action is taken pursuant to delegated authority under Section 0.321 of the
Commission's Rules, 47 C.F.R.  0.321.
