Box 11 Manhattan, IL 60442 Dear Mr. Kraus: This letter is in reference to the letter you filed on May 8, 1995 with respect to a complaint filed February 24, 1994, against the price Seneca Cable T.V. ("Seneca Cable") was charging for cable programming service in Seneca, Illinois, CUID No. IL0204. In that letter, you state that Seneca Cable's Seneca, Illinois system had 893 subscribers at the initial date of regulation. Based on the information you have provided, it appears that the Seneca, Illinois system qualifies as a "small system" pursuant to 47 C.F.R.  76.901(c), and was therefore exempt from rate regulation until May 15, 1994. We will rule at a later date on Seneca Cable's justification under the Commission's revised rate regulations of its cable programming service rates in Seneca, Illinois beginning May 15, 1994.
