Robert Felder President, Grassroots Cable Systems Industrial Drive Exeter Corporate Park P.O Box 280 Exeter, NH 03833 Dear Mr. Felder: This letter is in reference to the letter you filed on April 19, 1995 with respect to a complaint filed February 22, 1994, against the price Grassroots Cable Systems ("Grassroots") was charging for cable programming service in Middleton, New Hampshire, CUID No. NH0180. In that letter, you state that Grassroots's Middleton, New Hampshire system has 388 subscribers. Based on the information you have provided, it appears that the Middleton system qualifies as a "small system" pursuant to 47 C.F.R. 76.901(c), and was therefore exempt from rate regulation until May 15, 1994. We will rule at a later date on Grassroots's justification under the Commission's revised rate regulations of its cable programming service rates in Middleton beginning May 15, 1994.
