On April 5, 1994, Chronicle Publishing Company d/b/a Chronicle Cablevision of Hawaii; Jones Spacelink of Hawaii, Inc.; American Cable TV Investors 4, LTD. d/b/a Sun Cable Vision of Hawaii; Time Warner Cable d/b/a Oceanic Cable; Daniels Communications Partners L.P. d/b/a Hawaiian CableVision Company; and Kauai CableVision L.P. d/b/a Kauai CableVision ("Complainants") filed motions to dismiss with prejudice their pole attachment complaints against GTE Hawaiian Telephone Company, Incorporated ("GTE Hawaiian") and terminate the above- captioned proceedings. The Complainants state that to avoid the expense and uncertainty of litigation, the Complainants and GTE Hawaiian have decided to compromise and settle the claims at issue in those proceedings. The Complainants further state that dismissal of these complaints will affect no other parties and will serve the public interest by eliminating the need for unnecessary litigation and the concomitant expenditure of time and resources by the Commission and the parties. 2. Accordingly, IT IS ORDERED, pursuant to Sections 0.91 and 0.291 of the Commission's rules, 47 C.F.R. 0.91 and 0.291 that the Complainants' motions to dismiss ARE GRANTED.
