On April 20, 1994, TCI of West Michigan, Inc. ("TCI/WM") filed an appeal of the local rate orders, adopted March 21, 1994, by the municipalities identified above. In the local rate orders, the municipalities established regulated rates for basic cable service and associated equipment, provided by TCI/WM, as allowed by the Cable Television Consumer Protection and Competition Act of 1992. The local orders required TCI/WM to reduce the rates charged for basic cable service and equipment. 2. On March 20, 1995, TCI/WM filed with the Commission a motion to dismiss its earlier-filed appeal. In its motion, TCI/WM explained that the parties had reached agreement on a settlement. There being no opposition, TCI/WM's Motion to Dismiss is granted. 4. Accordingly, IT IS ORDERED THAT TCI/WM's Motion to dismiss appeal of the Local Rate Order for the municipalities of Michigan IS DISMISSED. 5.
