On June 9, 1994, Paragon Cable ("Paragon") filed an appeal of the local rate order, adopted May 10, 1994 by the Public Cable Television Authority ("PCTA") regulating basic service and equipment rates in the above-captioned communities. In the local rate order, the PCTA established regulated rates for basic cable service and associated equipment, provided by Paragon, as allowed by the Cable Television Consumer Protection and Competition Act of 1992. The local order required Paragon to reduce the rates charged for basic cable service and equipment. 2. On July 13, 1994, Paragon filed with the Commission a motion to withdraw its earlier-filed appeal and stay request. In its motion, Paragon explained that an appeal and stay are no longer necessary because the PCTA issued "a revised rate ordinance, which remedied some of the problems previously identified by Paragon." There being no opposition, Paragon's Motion to Withdraw is granted. 3. Accordingly, IT IS ORDERED THAT Paragon Cable's Motion to withdraw appeal and stay of the Local Rate Order for the Cities of Fountain Valley, Huntington Beach, Stanton and West Minister, California IS GRANTED. IT IS FURTHER ORDERED THAT Paragon Cable's appeal of the local rate order IS DISMISSED. 4.
