Here we consider a complaint about the price Ventura County Cablevision ("Operator") was charging for its cable programming service ("CPS") tier in the community  Y;-referenced above.h3; Y<ԍ#Xw PE37 XP# In addition to complaining about Operator's CPS rate as of the date the complaint was filed, the complainant also alleges that even though Operator restructured its rates effective September 1, 1993, Operator did not increase the number of channels on the CPS tier consistent with its restructured rate until October 31, 1993. Our jurisdiction to order a refund dates from the earliest date a complete and timely complaint is filed with the  YA -Commission. See 47 C.F.R.  76.961(b). In this case, the earliest valid complaint was filed on December 13, 1993. Since Operator increased the number of CPS channels before the date the complaint was filed, we do not have jurisdiction to consider the reasonableness of Operator's rate before the channel increase. h Operator has chosen to attempt to justify its price through a benchmark showing on FCC Form 393. This Order addresses the reasonableness of Operator's price only through May 14, 1994.
