Specifically, Telesat states that its Leesburg system is considered a satellite master antenna television system (SMATV) in that it serves a single private multiple unit dwelling known as Royal Oak Estates, and that it does not make use of any public rightofways. As supporting documentation, Telesat provides a sworn affidavit from a responsible company official  Y -certifying to the facts in the petition.+  Y2-#Xw PE37=9XP#э#Xj\  P6G;+XP#x#Xw PE37=9XP#Affidavit of Douglas Grace, Chief Engineer of Telesat Cablevision, Inc. dated November 8, 1993. Mr. Grace states that the Leesburg system serves a total of 64 subscribers, and that the system serves a private community known as the Royal Oaks Estates, a commonlyowned multiple unit dwelling. Further, Mr. Grace states that the system does not make use of any public rightofways. We also note that in a June 29, 1993, transmittal letter accompanying the system's 1993 Basic Signal Leakage Performance Report (FCC Form 320), Telesat notified the Commission of its SMATV status and requested that the Commission "unregister" [sic] the system since it did not meet the Commission's definition of a "cable system." Section 76.12 of the Commission's Rules  Yc&-requires cable systems to file a registration statement with the Commission. See 47 C.F.R.  76.12. This requirement does not apply to entities which are not cable systems. As a result of Telesat's June 29, 1993 transmittal letter the Commission discontinued the system's  Y )-registration as a cable system.#x6X@`7>FX@#+" y0*0*0*L"Ԍ Y-ԙ   x4.` ` The Communications Act of 1934, as amended,v= Yy-ԍxCommunications Act of 1934,  623(a)(2), 47 U.S.C.  543(a)(2).v and the Commission's rulesJ y= Y*-ԍx47 C.F.R.  76.905(a).J provide that only the rates of "cable systems" that are not subject to effective competition  Y-may be regulated. The Communications Act of 1934o *= Y-ԍxCommunications Act of 1934  602(7), 47 U.S.C.  522(7).o and the Commission's rulesH = Y^ -ԍx47 C.F.R.  76.5(a).H further provide that "the term "cable system" means a facility, consisting of a set of closed transmission paths and associated signal generation, reception, and control equipment that is designed to provide cable service which includes video programming and which is provided to multiple subscribers within a community." However, "such term does not include a facility that serves only subscribers in one or more multiple unit dwellings under common ownership, control or management, unless such facility or facilities uses any public rightof Y1-way." 1= Yn-ԍxCommunications Act of 1934  602(7)(B), 47 U.S.C.  522(7)(B); 47 C.F.R.  76.5(a)(2).   Y -x5.` ` Based on the evidence presented, we find that Telesat has submitted sufficient evidence demonstrating that it is not a cable system as defined by the Communications Act or the Commission's rules. As such, it is not subject to rate regulation. Accordingly, we grant its petition.  X- III. x ORDERING CLAUSES  Yb-x6.` ` Accordingly, IT IS ORDERED that the Petition for Reconsideration filed by Telesat Cablevision, Inc. challenging the certification of the City of Leesburg, FL to regulate  Y5-Telesat's rates IS GRANTED.  Y-x7.` ` IT IS FURTHER ORDERED that the certification of the City of Leesburg to  Y-regulate Telesat Cablevision's basic cable service rates IS RESCINDED. & = Y -ԍxOur action here has no effect on the City's ability to regulate the basic cable service rates of Lake County Cablevision, the other operator for which the City sought certification.
