On April 4, 1994, TCI Cablevision of St. Louis, Inc. ("TCI") filed an appeal of the local rate order, adopted on March 4, 1994 by TCI's franchising authority, the City of St. Louis (the "City"). In the local rate order, the City established regulated rates for basic cable service and associated equipment, provided by TCI, as allowed by the Cable Television Consumer Protection and Competition Act of 1992. The local order mandated rates for equipment well below the rates proposed by TCI. 2. On August 5, 1994, TCI filed with the Commission a motion to withdraw its earlier-filed appeal and stay request. In its motion, TCI stated that "[s]ince the appeal was filed . . . . the City adopted a new cable rate resolution," and therefore that "Commission review of the City's rate order of March 4 is no longer necessary or appropriate." There being no opposition, TCI's Motion to Withdraw is granted. 3. Accordingly, IT IS ORDERED THAT TCI Cablevision of St. Louis, Inc.'s Appeal of the Local Rate Order of the City of St. Louis, Missouri IS DISMISSED. IT IS FURTHER ORDERED that TCI Cablevision of St. Louis, Inc.'s Request for Emergency Stay IS DISMISSED. 4.
