X - Discussion  x6. In its amended benchmark filing of June 30, 1994, King calculated a maximum permitted price for the CPS tier of $7.32 per month. Upon review of King's filing, we have found no apparent errors that would require a recalculation of King's maximum permitted CPS price. However, King's actual price for the CPS tier was $7.40 per month. Thus, King has failed to demonstrate that its price for the CPS tier was not unreasonable.   XK- Conclusions  x7. Upon review of the record herein, we conclude that King's showing supports a maximum reasonable CPS tier price of $7.32 per month (plus franchise fee) for the period  Y-January 19, 1994 to May 14, 1994.U F! Y_-ԍ This finding is based solely on the representations of King listed in paragraph 5,  YH -supra. Should information come to our attention that these representations were materially  Y3!-inaccurate, we reserve the right to take appropriate action. Accordingly, IT IS ORDERED, pursuant to Section 0.321 of the Commission's Rules, 47 C.F.R.  0.321, that the January 7, 1994 complaint against the cable programming service price charged by King Videocable Company in Lake Elsinore, California, CUID No. CA0495, IS GRANTED TO THE EXTENT INDICATED HEREIN AND DENIED TO THE EXTENT INDICATED HEREIN. x11.
