No. 102385, 106 Stat. 1460 (1992); Communications Act,  623(c), as  X#-amended, 47 U.S.C.  543(c) (1993) (Cable Act of 1992). and our rules implementing it, 47 C.F.R. Part 76, Subpart N, the Commission must review CPS prices upon the filing of a valid complaint. Reg. 41042 (Aug. 2, 1993). Operators with valid CPS complaints filed against them prior to May 15, 1994 must demonstrate that their CPS prices were in compliance with the Commission's initial rules from the time the complaint was filed through May 14, 1994, and that their prices were in  Y-compliance with the revised rules from May 15, 1994 forward.M X-#Xj\  P6G;yoXP#э See Benchmark Order, 9 FCC Rcd at 4190, paras. 150152. Operators attempting to justify their prices for the period prior to May 15, 1994 through a benchmark showing must  Y_-complete and file FCC Form 393.Y_n M X~-#Xj\  P6G;yoXP#э Id.Y In each case captioned above, the operator did file either an FCC Form 393 benchmark rate justification submission, or a cost of service rate justification submission. x4. Under the Commission's rules, a complaint regarding a rate change for the CPS tier may be filed within 45 days from the date the complainant first receives a bill reflecting  Y -the rate change. ! M Y-ԍ 47 C.F.R.  76.953(b). Complaints about rates in effect on September 1, 1993 must be filed by February 28, 1994. 47 C.F.R.  76.953(a). However, after reviewing the records in these cases, we have determined that these complaints do not relate to changes in regulated CPS rates, but to charges that  Y -have remained unchanged since September 1, 1993.J v M Y-ԍ To the extent that these complaints object to changes in the rate charged for the basic tier and associated equipment, we lack jurisdiction to consider those complaints. Except in limited circumstances, the Commission does not have jurisdiction over rates for the basic service tier, and cannot act upon complaints concerning rates for that tier. When only basic rates are being challenged, the complaint should properly be brought to the attention of the local franchising authority in the first instance, and not filed with this Commission.J To challenge such rates, a complaint  Y-must be filed no later than February 28, 1994.E M Y:%-ԍ 47 C.F.R.  76.953(a).
