CTEC argues that its cable system is subject to effective competition because it  Y -serves fewer than 30 percent of the households in Somers Town, its franchise area. I? Y-#Xw PE37=9XP##XR  P7jQ=9XP#э The Commission's rules provide that only the rates of cable systems that are subject to effective competition may be regulated. The Commission's rules further provide that a cable system is subject to effective competition if fewer than 30 percent of the households in the system's franchise area subscribe to the cable service of a cable system. 47 C.F.R.  76.905(a) and (b)(1). CTEC claims that it serves only 1,712 of the 5,727 households in its franchise area, or 29 percent of the total number of households. As support CTEC submits a declaration under penalty  Y -of perjury which refers to a specific citeE  /I? Y!-#Xw PE37=9XP##Xw PE37=9XP#э In her declaration, Ms. DeWees cites to 1990 Census of Housing Bureau of the Census, U.S. Dept. of Commerce, 1990 CH134, 1990 Census of Housing, General Housing Characteristics, New York, Table 1, at 18.E in the 1990 Census which indicates that there are  Y -5,727 households (that is, occupied housing units)  I? Y!&-#Xw PE37=9XP##Xw PE37=9XP##Xw PE37=9XP##Xw PE37=9XP#э#Xw PE37=9XP# As the Commission noted recently, "we presume that Congress did not intend "households" to have a different meaning than in the 1990 Census that would include vacant" ' 0*(( '"  Y-units." The cable operator bears the burden of rebutting the presumption that effective competition does not exist with evidence that effective competition, as defined by Section 76.905 of the Commission's Rules, is present within its  Yv-franchise area. vI? Y-#Xw PE37=9XP##Xw PE37=9XP##XR  P7jQ=9XP##XR  P7jQ=9XP#э 47 C.F.R.  76.911(b)(1). Based on the evidence, we find that CTEC has met this burden. Order, supra.Ĝ Relying on this data, CTEC has submitted sufficient evidence that its system serves fewer than 30 percent of the households in the franchise area. Thus, we find that CTEC's system serving Somers Town is subject to effective competition. Accordingly, its petition is granted.
