NEWSReport No. CS 95-3 CABLE SERVICES ACTION March 1, 1995 CABLE OPERATORS GRANTED ADDITIONAL 30 DAYS TO FILE EQUIPMENT FORM The Cable Services Bureau today issued a letter granting cable operators a waiver of the requirement that Form 1205, "Determining Regulated Equipment and Installation Costs," be filed within 60 days after the end of the operator's fiscal year. The Bureau requires the information be filed annually to update regulated equipment and installation charges. Pursuant to the waiver, operators may have an additional 30 days to make this Form 1205 filing, if needed. The waiver is limited to fiscal year 1995 and is not a waiver of any other requirement related to the filing of Form 1205. The waiver was granted in a letter (DA95-381) on behalf of several cable operators. In the letter it is noted that some operators would have to rely on estimated data, instead of actual data, to file in time. An operator who wants to use the additional 30 days must notify the local franchising authority and the Commission (where certified to regulate basic tier service) that the operator intends to avail itself of the waiver. The notification must be accompanied by a copy of the Bureau's letter and a written assurance, which may be in the form of a brief explanatory letter, that compliance with the 60-day requirement is not feasible.
